Daisy Terms of Use

These are the terms for using Daisy, the app and the website at heydaisy.app. We kept them short and in plain English. By using Daisy you agree to them; if you do not agree, please do not use Daisy. Daisy is made by Everwell LLC, and you can reach us at daisy@everwell.ltd.

What Daisy is (and is not)

Daisy is a self-love app: a garden that grows as you look after yourself, small daily practices, a thirty-day journey of small steps, and a flower character you can talk to.

Daisy the character is an AI. She is not a person, and she is not a doctor, a therapist or a crisis service. Her words are written by a language model and can be wrong, incomplete or a poor fit for your situation. Please treat them as a friendly nudge, never as medical, mental health, legal or financial advice, and never as a substitute for care from a qualified professional.

If you are in crisis or thinking about harming yourself, please contact your local emergency number or a crisis line straight away. The app lists free helplines under Settings and in the chat.

Daisy is never a licensed professional and must not be relied on as one. If a message suggests you may be in crisis, Daisy stops the normal conversation and shows you the crisis resources.

Who can use Daisy

Daisy is for adults. You must be 18 or older to use it, and before the first conversation the app asks you to confirm this. If you are under 18, please do not use Daisy; the app will point you to free helplines instead.

Your garden and your words

Everything you write and grow is yours. We claim no rights over your journal, your chats or your garden. The letters, replies and paintings Daisy makes for you are yours to keep for personal use.

The Daisy character, name, art, words and app are ours (or our licensors') and stay ours. Please do not copy, sell or pass them off as your own.

Daisy keeps your data on your phone unless you switch on the optional backup. How all of that works is in our privacy policy, which is part of these terms.

Daisy Plus (subscriptions)

Some parts of Daisy belong to Daisy Plus, a paid subscription: for example the rest of the thirty days after the free first week, and the features marked Plus in the app.

Subscriptions are sold and billed by Apple (App Store) or Google (Google Play), not by us. The price, the length (monthly or yearly) and any free trial are shown before you buy. A subscription renews automatically at the end of each period unless you cancel at least 24 hours before it renews. You cancel in your Apple or Google subscription settings, not in the app, and deleting the app does not cancel a subscription. Refunds are handled by Apple or Google under their own rules.

We may change prices or what Plus includes. If a change affects a subscription you already have, the store will tell you before it applies.

Purchases through the App Store are also covered by Apple's standard licence terms.

Using Daisy well

Please use Daisy for yourself, kindly and lawfully. Do not try to break, copy, reverse-engineer or overload the app or our servers, do not use Daisy to harm or harass anyone, and do not give her other people's private information. We may limit or end access for anyone who misuses Daisy or our servers.

What we can promise (and what we cannot)

We work hard to keep Daisy running, safe and kind, but we provide it as it is. We cannot promise it will always be available, free of mistakes or right for you, and we cannot promise any particular result from using it.

To the fullest extent the law allows, we are not liable for losses that come from relying on Daisy's words, from the app being unavailable, or from things outside our control. Nothing in these terms limits rights the law gives you that cannot be limited, such as your consumer rights.

Where the law allows a limit, our total liability to you for anything connected with Daisy is capped at the greater of what you paid us for Daisy in the past twelve months or twenty US dollars.

Governing law and disputes

Daisy is operated by Everwell LLC, a New Mexico limited liability company in the United States. These terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-laws rules.

If something goes wrong, please email us first at daisy@everwell.ltd; most things we can sort out that way. Any dispute we cannot resolve informally will be handled by the state or federal courts located in New Mexico, unless the law where you live gives you the right to bring it where you are.

If part of these terms cannot be enforced

If any part of these terms is found unenforceable, the rest still applies. These terms and our privacy policy are the whole agreement between you and Everwell LLC about Daisy. If we do not enforce a term straight away, we have not given it up.

Ending

You can stop using Daisy anytime: cancel any subscription in your store settings, delete the backup in Settings if you made one, and delete the app. We may suspend or end access if these terms are broken, and we may one day stop offering Daisy; if we do, we will give notice where we reasonably can.

Changes

If these terms change, we will update the date above and post the new version here and in the app. Using Daisy after a change means you accept the new terms.
